Judge refuses to jail Lakeland Capitol riot suspect ahead of his wedding celebration

Joshua Doolin, one of five people from Polk County charged in connection with the U.S. Capitol riot, faced the prospect of being jailed less than two weeks before his planned wedding celebration.

Instead, a federal judge has allowed Doolin to remain free on bond and will also permit a co-defendant to attend Doolin’s nuptials celebration in Lakeland on Jan. 4.

U.S. District Judge Carl Nichols of the District of Columbia on Wednesday rejected a prosecutor's bid to revoke bond for Doolin, a Polk City resident. Federal prosecutor Matt Moeder argued that Doolin should be jailed until trial after FBI agents found a rifle in Doolin’s home earlier this month, a violation of his release conditions.

During the same video hearing, Nichols approved a request from co-defendant Joseph Hutchinson III to travel to Lakeland for Christmas and again for Doolin’s wedding and preliminary events. Hutchinson, a resident of North Lakeland at the time of the Jan. 6 riot, has been living in Georgia since before his arrest in June.

Doolin, 23, is charged with entering and remaining in a restricted building or grounds and disorderly and disruptive conduct in a restricted building or grounds. He is among four Polk County residents charged as a group for allegedly taking part in the riot that occurred in and outside the U.S. Capitol on Jan. 6.

Hutchinson, 25, is charged with assaulting, resisting or impeding law-enforcement officers, violent entry and disorderly conduct on the U.S. Capitol grounds and other crimes.

Hutchinson will serve as Doolin’s best man during the church wedding ceremony, according to court records and media reports. They are among five current and former Polk County residents facing charges for their alleged participation in the Jan. 6 insurrection carried out by supporters of former President Donald Trump.

One of their co-defendants, Jonathan Pollack of North Lakeland, remains a fugitive after being indicted in June. His sister, Olivia Pollock, was arrested at the family property.

FBI agents searched Doolin’s home on Dec. 2, carrying out a warrant issued by a magistrate judge from the U.S. District Court of the Middle District of Florida. Moeder did not explain in a previous hearing what prompted the search warrant.

The search found an AR-15 semi-automatic rifle under a bed in a spare bedroom of the home, described in court records as a single-wide manufactured home. Doolin’s wife, Morgan Doolin, told Nichols in a previous hearing that she hid the rifle under the bed and didn’t tell her husband about it.

(The couple were legally married earlier this year but plan to hold a religious ceremony Jan. 4, court records say.)

During Wednesday’s hearing, Morgan Doolin reiterated her claim. Joshua Doolin’s pre-trial release agreement required him to surrender all of his weapons, but Morgan Doolin said she didn’t think the presence of the gun would violate those terms if her husband didn’t know about it.

Morgan Doolin said her husband never entered the spare room.

During Wednesday’s hearing, Morgan Doolin told the judge that she nicknamed the rifle “Besty Ross,” for the woman credited with sewing the first American flag, according to Washington TV station NBC4. She said she planned to take the gun to her father in North Carolina.

Nichols approved Hutchinson's request to drive to Lakeland from Albany, Georgia, on Friday and return on Christmas Day. Hutchinson grew up in Lakeland, court records say, and currently lives in Albany, where he works in his father's business.

The conditions of Hutchinson’s release require him to get permission before leaving the federal jurisdiction of the Middle District of Georgia.

The judge also granted permission for Hutchinson to return to Lakeland on Dec. 30 and attend a series of events related to Joshua Doolin’s marriage celebration. Those include a bachelor party Jan. 1 at a Tampa restaurant and a rehearsal dinner at a Lakeland church on Jan. 3.

The wedding is scheduled for Jan. 4 at the same church, with a reception to be held later that day in Lakeland. Hutchinson is scheduled to return to Georgia on Jan. 5.

Prosecutors did not oppose Hutchinson’s request to travel to Lakeland for Christmas but did oppose his bid to return for Doolin’s wedding events.

Gabriel Pollock, the brother of two of Hutchinson's and Doolin’s co-defendants, is listed as a youth minister at the church where the wedding will be held. During Wednesday's hearing, Hutchinson’s lawyer said it is “unlikely” that Jonathan Pollock will be present at any of the wedding events, NBC4 reported.

Jonathan Pollock has remained a fugitive for six months despite alerts from the FBI and the Polk County Sheriff's Office seeking information about him. Court records offered no indication of whether Olivia Pollock planned to attend Doolin’s wedding.

Doolin’s lawyer has twice asked Nichols to remove a GPS ankle bracelet he wears as a condition of his pre-trial release, but the judge has denied both requests. Hutchinson will carry a GPS “beacon” device during his travels to and from Lakeland, according to court records.

A fifth Polk County resident, Corinne Montoni of Lakeland, was separately arrested in March and faces charges of obstruction of an official proceeding, entering and remaining in a restricted space and disorderly and disruptive conduct in a restricted building or grounds.
